The Administrator takes all necessary measures to ensure that its cooperating entities, subcontractors, and other cooperating entities also guarantee the application of appropriate security measures in every case when they process personal data on behalf of the Administrator. The Administrator continuously conducts risk analysis to ensure that personal data is processed by it in a secure manner – primarily ensuring that only authorized persons have access to the data and only to the extent necessary for the tasks they perform.

§ 3. WHAT PERSONAL DATA IS PROCESSED BY THE ADMINISTRATOR

1. Personal data - information relating to an identified or identifiable natural person. An identifiable natural person is one who can be identified, directly or indirectly, in particular by reference to an identifier such as a name, an identification number, location data, an online identifier or to one or more factors specific to the physical, physiological, genetic, mental, economic, cultural or social identity of that natural person. This includes the following information: IP address, form of address, first and last name, address, email address, phone number.

2. We process personal data of:

a) online store users, including those with an account,

b) customers,

c) contractors,

d) newsletter subscribers,

e) persons who have consented to marketing communication,

f) contacting persons, as well as persons who have provided the administrator with their personal data using other communication channels, i.e.: websites https://www.instagram.com/ and https://www.facebook.com (including mobile applications), whose operating principles are based on regulations provided in particular at https://www.facebook.com/legal/terms, provided respectively by Facebook Inc. or Facebook Ireland Limited (hereinafter also: "Facebook service"). The rules for the protection and use of personal data by Facebook and Instagram services are available, for example, at: https://www.facebook.com/policy.php. The administrator has no influence on the content of Facebook's legal regulations, including those concerning personal data.

§ 4. SCOPE, PURPOSE AND LEGAL BASIS AND PERIOD OF PROCESSING OF COLLECTED DATA

1. INFORMATION OF THE PERSONAL DATA ADMINISTRATOR PREPARED ON THE BASIS OF ART. 13(1) and (2) OF THE GENERAL DATA PROTECTION REGULATION (GDPR)
In connection with the entry into force and the necessity of applying Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation) (hereinafter referred to as “the Regulation”), the owner of the internet domain provides the following information regarding the principles of processing your personal data. Personal data is processed by the administrator on the website in order to enable the use of the functionalities of the online store, including automatically when using the website, i.e., for the purpose of:

c) concluding a contract via the online store – for this purpose, we process personal data in the form of: IP address, cookies, email address, first and last name, address details (street, house number, city with postal code, country), data for invoicing, payment data, contact phone number, order number or other data provided by the service provider on the website or during contact with the customer; we process data based on Art. 6(1)(b) of the GDPR; data for this purpose will be processed for no longer than 6 years.

d) fulfilling the administrator's obligations as a seller and service provider – for this purpose, the following data are processed: first name, last name, order data, payment data, e-mail, phone, street address, house number, city with postal code, country, bank account number, data for issuing an invoice or other document, e.g. NIP, PESEL; we process data based on art. 6 sec. 1 lit. c) RODO – in particular in the scope of obligations resulting from tax law; data for this purpose will be processed for no longer than 5 years, counting from the end of the calendar year in which the tax payment deadline related to the contract concluded with the administrator expired.

e) sending by the administrator to the email address indicated by the customer the ordered newsletter, as well as commercial information to the indicated communication channels [email, SMS, phone] - for this purpose we process contact data email address, phone number, order data, first name, last name, address (street, house number, city with postal code), IP address, cookies, order data and resulting data - personal data for this purpose we process on the basis of expressed consent in this regard on the basis of art. 6 ust 1 lit. a) RODO; data for this purpose will be processed for no longer than 5 years.

f) for statistical and analytical purposes, adapting the website to your preferences – based on consent art. 6 ust 1 lit a) RODO - we process personal data for this purpose using the tools and cookies described in this privacy policy based on expressed consent in this regard on the basis of art. 6 ust 1 lit a) RODO; data for this purpose will be processed for no longer than 12 months.

g) for the purpose of realizing the legitimate interest of the personal data administrator on the basis of Art. 6(1)(f) GDPR, which is:

- fulfilling complaint obligations regarding the online store, processing product complaints,

- conducting and operating the online store and ensuring the security of its use, including for detecting abuses and conducting analyses, statistics, surveys, satisfaction research,

- preparation and presentation of advertisements and offers tailored to the interests and needs of the data subjects and receiving commercial information, in particular sending by the administrator to the email address indicated by the client the ordered newsletter;

- for the purpose of establishing, defending, and pursuing claims, for data archiving purposes.

2. User activity in the online store, including their personal data, is recorded in system logs (a chronological record of electronic data containing information about events and actions concerning the online store used to provide electronic services by the administrator). Information collected in the logs is processed based on the legitimate interest of the administrator (Art. 6(1)(f) GDPR) for a period of up to 12 months, primarily for purposes related to the operation of the online store and is processed for service, technical, analytical, statistical purposes, and for the needs of ensuring the security of the IT system and managing this system.

3. To the remaining extent justified by the purposes of processing, personal data will be stored as long as there is a legal basis for their processing, unless applicable law would require a longer period of their storage, e.g., for use in legal proceedings where the data subject and the administrator are parties.

4. At the end of the storage period and in the absence of another legal basis for their processing, personal data will be deleted or anonymized.

§ 5 RECIPIENTS

1. The transfer of data by the administrator does not occur in every case and not to all recipients or categories of recipients indicated in the privacy policy – the administrator transfers data only when it is necessary for the realization of a given purpose of personal data processing and only to the extent necessary for its realization.

2. In connection with the provision of services, personal data will be disclosed to external entities supporting the administrator's operations, including in particular:

a) providers responsible for servicing IT systems [IT support in terms of online store operation, email hosting, service, server services),

b) entities such as banks and payment operators - handling electronic payments or payment cards – in the case of a customer who uses electronic payment methods or payment cards on the website, the administrator provides the collected personal data to the selected entity handling the above payments on the website on behalf of the administrator to the extent necessary to handle the payment,

c) marketing agencies and IT system providers used to support marketing (in terms of marketing services),

d) providers of accounting, legal, advisory services providing the administrator with accounting, legal or advisory support (in particular, an accounting office, law firm or debt collection company).

3. Data recipients may also include providers of social plugins, scripts, and other similar tools placed on the website, allowing the browser of the person visiting the website to download content from the providers of these plugins and transmit personal data of the visiting person to these providers for this purpose, including: Facebook Ireland Ltd. – the administrator uses social plugins of Facebook and Instagram on the online store website and therefore collects and shares personal data of the service recipient using the online store website to Facebook Ireland Ltd. (4 Grand Canal Square, Grand Canal Harbour, Dublin 2 Ireland) to the extent and in accordance with the privacy rules available here: https://www.facebook.com/about/privacy/ (this data includes information about activities on the website – including information about the device, visited websites, purchases, displayed ads, and how services are used – regardless of whether the online store user has a Facebook account and whether they are logged in to Facebook).

4. Data recipients may also include public authorities and entities performing public tasks, e.g., in the case of reporting fraud – relevant judicial authorities, as well as to the extent and for the purposes resulting from legal provisions, e.g., conducting control proceedings with the administrator, the anti-money laundering act.

§ 6 DATA TRANSFER OUTSIDE THE EEA

If the administrator transfers personal data to a third country. In the event of transferring personal data outside the European Economic Area, such transfer may only take place on the terms specified in Art. 46, Art. 47 or 49 GDPR. The administrator transfers personal data outside the EEA only when it is necessary and with the assurance of an adequate level of protection, primarily through: cooperation with entities processing personal data in countries for which a relevant European Commission decision has been issued; application of standard contractual clauses issued by the European Commission; application of binding corporate rules, approved by the competent supervisory authority. The administrator always informs about the intention to transfer personal data outside the EEA at the stage of their collection.

§ 7 PROFILING OF PERSONAL DATA

Personal data will be processed in an automated manner, including profiling for the purposes of so-called ordinary profiling (e.g., adapting communications, banners to interests) – to better tailor informative and marketing messages about the administrator, its products and services, as well as entities related to the administrator [link]. We strive for our promotional, informational and marketing materials to be valuable to the data subject, which is why, in order to adapt marketing information to the individual preferences and interests of a given customer [presenting advertisements, offers, promotions (discounts)], information regarding the use of the online store is used, e.g., by analyzing how often you visit the online store, data on orders, activities in the administrator's sales channels (computer IP, cookies, preferred purchase methods), data on interest in the administrator's offer/newsletter or assortment, socio-demographic data (e.g., gender, age, location). We strive for the information obtained through profiling using automated IT systems to form the basis for analyzing customer expectations, analyzing the administrator's direction of action, without significantly affecting the customer's decisions.

§ 8 VOLUNTARY PROVISION OF PERSONAL DATA

The provision of personal data on the website is voluntary, but necessary for the realization of one or more of the personal data processing purposes indicated in § 4 sec. 1 above, which the administrator will not be able to realize in case of non-provision of personal data.

§ 9 RIGHTS OF THE DATA SUBJECT RELATED TO PERSONAL DATA PROTECTION

1. In exercising your rights, please send correspondence to the contact details provided in § 2 of the policy. Please also provide all necessary information that will allow us to unequivocally identify the identity of the entity exercising the rights.

2. Every entity whose data the administrator processes has the right to:

a) access to the content of personal data, including requesting a copy thereof, 10

b) request rectification,

c) erasure of personal data (right to be forgotten),

d) restriction of personal data processing,

e) the right to data portability to another administrator, if the processing is based on a contract [Art. 6(1)(b) GDPR] or consent [Art. 6(1)(a) GDPR],

f) the right to object to the processing of personal data, in particular to direct marketing based on Article 6(1)(f) GDPR. The right to object to the processing of personal data for purposes based on Article 6(1)(f) GDPR for reasons related to a particular situation,

g) the right to lodge a complaint with the President of the Personal Data Protection Office.

h) withdrawal of consent, which may occur at any time. Withdrawal of consent does not affect data processing performed before its withdrawal. Consents may be revoked by them at any time, without affecting the legality of the processing,

§ 10 COOKIES AND SIMILAR TECHNOLOGY

1. The Administrator collects information about every person visiting the online store using cookies (or similar functionality to cookies). The website uses so-called cookies, and detailed information in this regard is presented below. Obtaining and storing information using cookies is possible based on the user's consent. By default, web browsers or other software installed on a computer or other device connected to the network allow cookies to be placed on such a device.

Cookies collect information that facilitates the use of the website - e.g., by remembering the user's visits to the website and the actions they perform. To the extent that the administrator's partners providing tools supporting the online store's operation may also have direct access to this information - the legal basis for such processing is the voluntary consent expressed by the client.

7. The user can independently and at any time change the settings regarding cookies, determining the conditions for their storage and access by cookies to the user's device. The user can make the changes to the settings mentioned in the previous sentence by using the web browser settings or by configuring the service. These settings can be changed in particular to block the automatic handling of cookies in the web browser settings or to inform about each placement of cookies on the user's device. 9. Limiting the use of cookies may affect some functionalities available on the service's website.

10. Every service user should take care of the security of their devices used to access the internet. Such a device should have antivirus software with an up-to-date virus definition database, a current and secure version of the web browser, and an enabled firewall. The user should also regularly check whether the operating system and installed programs have the latest updates, as attacks exploit errors detected in installed software. Software manufacturers try to eliminate such threats through updates.

The use of cookies to collect data for marketing purposes or purposes other than those necessary for displaying the website, including accessing data stored on the user's device, requires the user's consent. Facebook Ads is an advertising system within Facebook and is provided by Facebook, Inc., 1602 S. California Ave., Palo Alto, CA 94304, USA, which we use to display advertisements to Facebook users within which the service uses so-called remarketing codes. The codes are used to match individualized advertisements to individual customers and then display them in the advertising network of a given provider (Google, Facebook). With the help of Google Adwords, we promote our website in search results and on third-party websites.
